
The Department of Health & Human Services (HHS) released a new model HIPAA Notice of Privacy Practices on February 13, 2026. HIPAA mandates that health plans update their notice if there is a material change to the uses or disclosures of protected health information (PHI). Employers who offer a Flexible Spending Account (FSA) or Health Reimbursement Arrangement (HRA) must provide employees with the updated notice. For more information from HHS, please click here.

Employer Action Required
Employers must make this notice accessible to all covered employees. You can choose from one of the following distribution methods:
- Post the revised notice on your company’s intranet. To access a copy of the revised notice, please click here.
- Email the notice.
- Mail the notice.
- Opt for P&A to mail the notice on your behalf (see fee and details below) – please note, a mailing request form must be completed. If you would like a copy of the mailing request form, please contact marketing@padmin.com.
Checklist: Utilizing P&A’s Mailing Service

- Cost: Employers who choose this option will be charged $3.50 per notice mailed. This cost includes the physical hard copy of the notice, stamp and mailing expenses.
- Complete the Mailing Request Form: Employers who want to select this option should complete the mailing request form. If you do not have a copy of the form, please contact marketing@padmin.com.
Important Deadline for the HIPAA Privacy Notice Change
If your company does not utilize an intranet for benefit postings, you must ensure the revised notice is provided to employees no later than April 17, 2026.
